At Nyxure, an Indian multi-vendor e-commerce marketplace owned and operated by Radhekishori Ecom Private Limited, we are committed to maintaining a safe, lawful, trustworthy, and responsible marketplace for customers and sellers.
Nyxure allows independent sellers to offer eligible products to customers through our marketplace. However, not every product is permitted to be listed, sold, advertised, or distributed through Nyxure.
This Prohibited & Restricted Products Policy establishes the categories of products and activities that are not permitted on Nyxure and the categories that may be permitted only when applicable legal, regulatory, licensing, documentation, safety, age, labeling, or other requirements are satisfied.
The purpose of this Policy is to:
- Protect customers and sellers.
- Prevent unlawful or unsafe products from being offered through Nyxure.
- Protect intellectual property and brand rights.
- Prevent fraudulent, counterfeit, dangerous, or deceptive products.
- Support compliance with applicable Indian laws and regulations.
- Maintain the integrity and reputation of the Nyxure marketplace.
This Policy forms part of Nyxure’s marketplace rules and should be read together with our Terms & Conditions, Seller Terms & Conditions, Seller Code of Conduct, Intellectual Property Policy, Privacy Policy, Return & Refund Policy, Cancellation Policy, Shipping & Delivery Policy, Disclaimer, and other applicable policies.
Seller Responsibility
Sellers are responsible for ensuring that every product they list, sell, advertise, or otherwise offer through Nyxure complies with:
- Applicable Indian laws and regulations.
- Applicable state and local requirements.
- Product-specific licensing requirements.
- Applicable safety standards.
- Applicable labeling and packaging requirements.
- Applicable age restrictions.
- Applicable import and export requirements.
- Applicable intellectual property requirements.
- Nyxure’s marketplace policies and seller requirements.
Sellers must not list a product merely because it is available for sale elsewhere.
A product must satisfy both applicable legal requirements and Nyxure’s marketplace requirements before it may be offered through Nyxure.
Nyxure may request documents, licenses, registrations, certificates, invoices, authorization letters, or other information to verify eligibility.
Product Categories
Products on Nyxure may generally fall into one of the following categories:
A. Prohibited Products
Products that are not permitted to be listed, sold, advertised, or distributed through Nyxure.
B. Restricted Products
Products that may be permitted only when specific requirements are satisfied.
C. Conditionally Accepted Products
Certain products may be accepted only for approved sellers, approved brands, approved categories, or approved locations and may require additional verification before listing.
Nyxure may determine whether a particular product falls into one or more of these categories.
Prohibited Products
The following categories are generally prohibited on Nyxure.
3.1 Illegal Products
Products whose sale, possession, distribution, importation, exportation, advertising, or use is prohibited under applicable law.
This includes products that are unlawful to sell or distribute in India or in the applicable jurisdiction.
3.2 Stolen or Illegally Obtained Goods
Products that the seller knows or reasonably should know are:
- Stolen.
- Illegally obtained.
- Misappropriated.
- Acquired through fraudulent means.
- Connected with unlawful activity.
Sellers must be able to demonstrate lawful sourcing where reasonably requested.
3.3 Counterfeit Products
Nyxure strictly prohibits counterfeit and fake products.
This includes products that:
- Falsely bear a trademark.
- Imitate branded goods without authorization.
- Are falsely represented as genuine.
- Use unauthorized brand packaging.
- Falsely claim association with a brand.
- Are intended to deceive customers regarding authenticity or origin.
Additional requirements may apply under Nyxure’s Intellectual Property Policy.
3.4 Products Infringing Intellectual Property Rights
Products or listings that unlawfully infringe another party’s:
- Copyright.
- Trademark.
- Patent.
- Design rights.
- Trade dress.
- Other intellectual property rights.
This may include unauthorized use of:
- Brand logos.
- Product images.
- Copyrighted photographs.
- Product descriptions.
- Artwork.
- Videos.
- Packaging.
- Other protected content.
- 3.5 Illegal Drugs and Narcotic Substances
Nyxure prohibits products that are unlawful to sell, distribute, possess, or supply under applicable narcotics, pharmaceutical, or other laws.
This includes illegal narcotic substances and other prohibited controlled substances.
3.6 Weapons and Certain Dangerous Weapons
Nyxure generally prohibits the listing or sale of unlawful weapons and other products whose sale or possession requires authorization that the seller cannot provide.
This may include prohibited or unlawfully offered:
- Firearms.
- Ammunition.
- Explosives.
- Illegal weapons.
- Certain prohibited weapon components.
- Other products restricted under applicable weapons laws.
Products that may legally be sold only with specific licenses, permits, or authorizations may be treated as restricted products and require prior approval.
3.7 Explosives and Explosive Materials
Products involving unlawful explosives, explosive materials, or explosive devices are prohibited.
This includes products that cannot lawfully be sold, transported, stored, or supplied through ordinary marketplace channels.
3.8 Hazardous and Unlawful Chemicals
Nyxure may prohibit chemicals or substances that are:
- Illegal.
- Unlawful to sell to consumers.
- Highly dangerous.
- Restricted by applicable law.
- Subject to specialized handling requirements that cannot be satisfied through Nyxure’s ordinary fulfillment channels.
Certain lawful chemicals may be permitted only subject to applicable documentation, packaging, labeling, storage, transportation, and seller requirements.
3.9 Human Organs, Human Tissue, and Human Remains
The sale, purchase, or unauthorized transfer of human organs, human tissue, human remains, or similar materials is prohibited.
3.10 Human Trafficking and Exploitative Services
Nyxure prohibits listings or services involving:
- Human trafficking.
- Forced labor.
- Sexual exploitation.
- Exploitation of minors.
- Slavery or servitude.
- Other unlawful exploitation of persons.
- 3.11 Child Sexual Abuse Material and Exploitative Content
Any content or product involving the sexual exploitation of children or other unlawful sexual exploitation is strictly prohibited.
Such material may be reported to appropriate authorities where required by law.
3.12 Obscene or Unlawful Sexual Content
Products or content that are unlawful to sell, distribute, advertise, or possess under applicable law are prohibited.
Nyxure may also prohibit sexually explicit products or content where necessary to maintain marketplace standards or comply with applicable laws, payment requirements, logistics restrictions, or platform policies.
3.13 Products Promoting Terrorism or Violent Extremism
Products or content that promote, support, glorify, facilitate, or materially assist terrorism or unlawful violent extremist activity are prohibited.
This includes merchandise or materials that unlawfully promote such organizations or activities.
3.14 Products Encouraging Illegal Activity
Products or materials primarily intended to facilitate unlawful activity may be prohibited.
Examples may include products designed specifically to facilitate:
- Fraud.
- Identity theft.
- Unauthorized access.
- Counterfeiting.
- Theft.
- Other unlawful conduct.
- 3.15 Government-Issued Documents and Identification
The unauthorized sale, transfer, reproduction, or distribution of government-issued identity documents, certificates, licenses, permits, or similar official documents is prohibited.
3.16 Fake or Fraudulent Documents
Nyxure prohibits the sale or distribution of forged, counterfeit, fabricated, or fraudulent:
- Certificates.
- Licenses.
- Academic credentials.
- Government documents.
- Medical documents.
- Financial documents.
- Other official records.
- 3.17 Products Making Fraudulent or Misleading Claims
Products must not be marketed using false, deceptive, fraudulent, or materially misleading claims.
Examples may include unsupported claims relating to:
- Health.
- Medical treatment.
- Disease prevention or cure.
- Guaranteed financial returns.
- Guaranteed weight loss.
- Guaranteed employment.
- Guaranteed investment results.
- Product performance.
- Product origin.
- Product authenticity.
Restricted Products
Restricted products are not necessarily prohibited, but sellers may list them only when all applicable requirements are satisfied.
Nyxure may require prior approval, additional documentation, category approval, or seller verification before allowing such products to be listed.
Food and Beverages
Food and beverage products may be permitted subject to applicable food safety, licensing, labeling, packaging, expiry, storage, transportation, and other requirements.
Sellers offering food products must maintain the appropriate FSSAI registration or license, where applicable.
FSSAI states that food business operators are required to be licensed or registered under the applicable food safety framework, and FSSAI recognizes e-commerce as a regulated food-business category.
Food listings may be required to provide appropriate information, including where applicable:
- Product name.
- Ingredients.
- Net quantity.
- Manufacturer/packer details.
- FSSAI information.
- Batch information.
- Manufacturing or packing date.
- Best-before or expiry information.
- Applicable nutritional information.
- Allergen information.
- Other legally required declarations.
Nyxure may restrict products that do not satisfy applicable food safety or labeling requirements.
Medicines, Drugs, and Pharmaceutical Products
Medicines, drugs, pharmaceutical products, and related healthcare products may be subject to specific legal and regulatory requirements.
Nyxure may restrict or prohibit:
- Prescription medicines.
- Controlled medicines.
- Unapproved medicines.
- Misbranded medicines.
- Products requiring specialized licenses.
- Products that cannot lawfully be sold through the applicable channel.
Where such products are permitted, sellers must possess all required licenses, registrations, authorizations, and documentation.
Nyxure may require additional verification before allowing pharmaceutical or healthcare products to be listed.
Medical Devices and Healthcare Products
Medical devices and regulated healthcare products may be restricted depending on their classification and applicable regulatory requirements.
Sellers must ensure that applicable:
- Licenses.
- Registrations.
- Certifications.
- Standards.
- Labeling requirements.
- Safety requirements.
are satisfied before listing such products.
Products making unsupported medical claims may be removed or restricted.
Cosmetics and Personal Care Products
Cosmetics and personal care products may be listed only when they comply with applicable Indian laws, safety requirements, labeling requirements, and other regulatory standards.
Sellers must ensure that products are genuine and properly labeled.
Products that are expired, adulterated, counterfeit, unsafe, or unlawfully marketed may be removed.
Tobacco Products
Tobacco products are subject to specific legal restrictions in India, including requirements relating to sale, advertising, packaging, age restrictions, and sale near educational institutions.
Accordingly, tobacco products may be restricted or prohibited on Nyxure depending on the product, applicable law, seller authorization, logistics limitations, and marketplace requirements.
Nyxure may impose requirements stricter than the minimum legal requirements.
Products containing tobacco or nicotine that are prohibited under applicable law are not permitted.
Electronic Cigarettes and Similar Products
Electronic cigarettes and products covered by India’s prohibition on electronic cigarettes are prohibited on Nyxure.
This includes products whose manufacture, import, export, transport, sale, distribution, storage, or advertisement is prohibited under applicable law.
Alcoholic Beverages
Alcoholic beverages may be subject to state-specific licensing, sale, advertising, transportation, age, and distribution requirements.
Nyxure may prohibit alcoholic beverages from being sold through the marketplace unless the applicable legal, licensing, operational, payment, and logistics requirements can be satisfied.
Nyxure may impose a complete marketplace prohibition even where a product may otherwise be lawful in a particular jurisdiction.
Fireworks
Fireworks and pyrotechnic products may be subject to strict requirements relating to manufacture, licensing, storage, transportation, sale, and use.
Nyxure may prohibit or restrict fireworks and pyrotechnic products based on applicable law, courier limitations, safety concerns, seasonal restrictions, and marketplace requirements.
Pesticides, Insecticides, and Agricultural Chemicals
Agricultural chemicals, pesticides, insecticides, herbicides, fungicides, and similar products may require specific registrations, licenses, labeling, packaging, and handling requirements.
Only legally permitted products may be listed.
Nyxure may require sellers to provide appropriate authorization or documentation before listing such products.
Batteries, Chemicals, and Dangerous Goods
Certain products may be classified as dangerous goods or hazardous materials for transportation purposes.
Examples may include certain:
- Lithium batteries.
- Chemicals.
- Flammable substances.
- Compressed gases.
- Corrosive substances.
- Toxic substances.
- Other hazardous materials.
Such products may be restricted or prohibited depending on applicable transportation, packaging, storage, courier, and legal requirements.
Products Subject to Recall or Safety Warnings
Products subject to:
- Government recall.
- Manufacturer recall.
- Safety warning.
- Regulatory prohibition.
- Product withdrawal.
- Serious safety concerns.
may be removed or restricted from Nyxure.
Sellers must immediately inform Nyxure where they become aware that a listed product is subject to a recall or serious safety concern.
Used, Refurbished, and Open-Box Products
Used, refurbished, renewed, repaired, or open-box products may be permitted in appropriate categories, subject to Nyxure’s category requirements.
Sellers must accurately disclose the condition of the product.
Sellers must not represent:
- Used products as new.
- Refurbished products as new.
- Repaired products as factory-new.
- Open-box products as unopened.
Nyxure may establish additional requirements for such products.
Expired, Damaged, or Unsafe Products
Sellers must not list products that are:
- Expired.
- Damaged in a manner affecting safety or usability.
- Tampered with.
- Contaminated.
- Recalled.
- Unsafe for normal consumer use.
- Missing legally required information.
Perishable or time-sensitive products may be subject to additional requirements.
Wildlife and Protected Species
Products involving protected wildlife, endangered species, or materials derived from protected animals or plants may be prohibited or restricted.
This may include products involving:
- Protected animal parts.
- Ivory.
- Protected skins.
- Rare or protected species.
- Protected plants.
- Other materials restricted under applicable wildlife or environmental laws.
Sellers must not list such products without all legally required permissions and documentation.
Cultural Property and Antiquities
Antiquities, archaeological objects, cultural property, and other protected heritage items may be subject to specific laws and restrictions.
Nyxure may prohibit or restrict such products where ownership, sale, export, import, provenance, or authenticity cannot be adequately established.
Recalled, Stolen, or Unauthorized Branded Goods
Sellers must not list products that they know or reasonably should know are:
- Stolen.
- Recalled.
- Unauthorized.
- Illegally imported.
- Counterfeit.
- Fraudulently sourced.
Nyxure may request invoices, purchase records, authorization documents, or other evidence of lawful sourcing.
Digital Goods and Services
Digital products and services may be subject to additional restrictions.
Sellers must not offer:
- Unauthorized software licenses.
- Pirated software.
- Stolen digital accounts.
- Unauthorized access credentials.
- Hacked accounts.
- Unauthorized digital keys.
- Content that infringes copyright.
- Services facilitating unlawful access or activity.
Legitimate digital products may be subject to additional approval and verification.
Financial Products and Investment Opportunities
Products or services involving financial investments, securities, lending, insurance, cryptocurrency, or other regulated financial activities may require specific authorization.
Nyxure may prohibit or restrict such products and services unless the seller can demonstrate that the offering is lawful and appropriately authorized.
Nyxure does not permit fraudulent investment schemes or guaranteed-return claims.
Gambling and Betting
Products or services facilitating unlawful gambling, betting, lotteries, or similar activities may be prohibited.
The legality of gambling and betting activities can vary by jurisdiction and activity.
Nyxure may impose stricter marketplace restrictions than applicable local law.
Alcohol, Nicotine, and Age-Restricted Products
Products subject to age restrictions may require:
- Age verification.
- Seller verification.
- Delivery restrictions.
- Special labeling.
- Applicable licenses.
- Special payment or logistics arrangements.
Nyxure may prohibit age-restricted products where it cannot reasonably implement appropriate safeguards.
Products Requiring Special Licensing
A product may be restricted where its manufacture, possession, sale, distribution, import, export, storage, or transportation requires a license, permit, registration, certification, or other government authorization.
The seller is responsible for obtaining and maintaining all required approvals.
Nyxure may request evidence of such approvals before or after listing.
Products Restricted by Courier or Logistics Partners
Certain products may be legally saleable but unsuitable for transportation through Nyxure’s available logistics partners.
Nyxure may restrict products because of:
- Dangerous-goods restrictions.
- Packaging requirements.
- Size or weight limitations.
- Geographic restrictions.
- Temperature requirements.
- Fragility.
- Insurance limitations.
- Courier policies.
A product may therefore be restricted on Nyxure even where its sale is otherwise lawful.
Geographic Restrictions
Certain products may be legal in one jurisdiction but restricted or prohibited in another.
Nyxure may restrict sales based on:
- State or local laws.
- Customer location.
- Seller location.
- Delivery restrictions.
- Regulatory requirements.
- Courier availability.
A seller must not attempt to bypass geographic restrictions.
Misleading, Unsafe, or Non-Compliant Products
Nyxure may restrict or remove any product that:
- Creates an unreasonable safety risk.
- Contains materially misleading information.
- Has false specifications.
- Has inaccurate origin information.
- Has manipulated reviews or ratings.
- Has misleading photographs.
- Is materially different from the product described.
- Violates applicable product standards.
- Violates Nyxure’s marketplace rules.
Product Documentation and Verification
Nyxure may require sellers to provide documentation relating to a product.
Depending on the category, this may include:
- Invoices.
- Purchase records.
- Brand authorization.
- Licenses.
- Registrations.
- Certificates.
- Product test reports.
- Safety certifications.
- FSSAI documentation.
- Import documentation.
- Manufacturer information.
- Product photographs.
- Packaging photographs.
- Other relevant documents.
Failure to provide requested documentation may result in listing restrictions or seller enforcement action.
Nyxure Right to Restrict Additional Products
The product categories listed in this Policy are not exhaustive.
Nyxure may restrict or prohibit additional products where it reasonably considers this necessary because of:
- Applicable law.
- Regulatory requirements.
- Safety concerns.
- Fraud risks.
- Intellectual property concerns.
- Payment-provider requirements.
- Courier restrictions.
- Marketplace integrity.
- Customer protection.
- Seller protection.
- Operational limitations.
Nyxure may also introduce category-specific requirements.
Product Eligibility Does Not Guarantee Listing Approval
Compliance with applicable law does not automatically guarantee that Nyxure will permit a product to be listed.
Nyxure may establish marketplace standards that are stricter than minimum legal requirements.
Nyxure may therefore decline a product category, seller, brand, or listing for legitimate business, safety, operational, compliance, or marketplace-integrity reasons.
Seller Enforcement
If a seller lists or attempts to sell prohibited or restricted products in violation of this Policy, Nyxure may take one or more actions, including:
- Rejecting the listing.
- Removing the listing.
- Restricting the product.
- Requesting additional documentation.
- Suspending the listing.
- Cancelling affected orders where appropriate.
- Restricting seller privileges.
- Suspending the seller account.
- Withholding or restricting certain marketplace privileges where permitted.
- Terminating the seller’s participation in Nyxure.
- Reporting suspected unlawful activity to appropriate authorities where required or appropriate.
The action taken may depend on the seriousness and circumstances of the violation.
Repeated Violations
Repeated violations may result in progressively stronger enforcement.
Factors Nyxure may consider include:
- Number of violations.
- Nature of the products.
- Potential customer harm.
- Whether the seller acted knowingly.
- Previous warnings.
- Seller cooperation.
- Evidence of fraudulent conduct.
- Whether the seller attempted to circumvent marketplace controls.
Serious violations may result in immediate suspension or termination.
Circumvention Is Prohibited
Sellers must not attempt to bypass Nyxure’s product restrictions by:
- Using misleading product titles.
- Misclassifying products.
- Splitting prohibited products into multiple listings.
- Using coded language.
- Providing prohibited products through order notes.
- Redirecting customers to external websites.
- Creating replacement listings after removal.
- Using another seller account.
- Providing prohibited products as a bundle or free gift.
- Concealing the true nature of a product.
Attempts to circumvent this Policy may result in immediate enforcement action.
Customer Reports
Customers may report products that they believe:
- Are prohibited.
- Are counterfeit.
- Are unsafe.
- Are illegal.
- Are materially different from the listing.
- Violate this Policy.
- Violate another Nyxure policy.
Customers may report concerns through the Nyxure Help Center or applicable customer-support channels.
Nyxure may investigate reported products and take appropriate action.
Regulatory and Government Requests
Nyxure may cooperate with competent government authorities, regulators, law-enforcement agencies, courts, or other legally authorized bodies where required or permitted by applicable law.
Where legally required, Nyxure may provide relevant information concerning sellers, products, listings, transactions, or other marketplace activity.
No Guarantee of Continuous Availability
Nyxure does not guarantee that every legally permitted product category will always be available for sale through the marketplace.
Nyxure may add, remove, restrict, or modify product categories at any time based on:
- Legal requirements.
- Safety considerations.
- Business requirements.
- Logistics availability.
- Payment requirements.
- Marketplace standards.
- Regulatory developments.
Relationship With Sellers
Products listed on Nyxure are sold by independent sellers.
Sellers remain responsible for the legality, authenticity, safety, quality, sourcing, licensing, labeling, packaging, and compliance of the products they offer, subject to applicable law and the terms governing their participation on Nyxure.
Nyxure controls and operates the marketplace and may enforce this Policy against sellers and listings.
