Welcome to Nyxure (“Marketplace,” “we,” “our,” or “us“), a marketplace operated by Radhekishori Ecom Private Limited.
These Terms & Conditions (“Terms”) govern your access to and use of our website, products, services, and marketplace platform available at https://www.nyxure.com.
By accessing or using Nyxure, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, please do not access or use our Marketplace.
- Definitions
For the purpose of these Terms:
• “Marketplace” means the online multi-vendor marketplace operated under the brand name Nyxure by Radhekishori Ecom Private Limited.
• “Company”, “we”, “our”, or “us” refers to Radhekishori Ecom Private Limited, the owner and operator of Nyxure.
• Customer means any individual or organization purchasing products through the Marketplace.
• Seller or Vendor means any approved merchant selling products through Nyxure.
• User means any individual accessing or using the Marketplace.
• Product means any physical or digital item listed for sale.
• Order means a purchase placed through the Marketplace.
- Eligibility
To use this Marketplace you must:
• Be at least 18 years old or have permission from a parent or legal guardian.
• Provide accurate registration information.
• Maintain the confidentiality of your account credentials.
• Accept responsibility for all activities conducted under your account.
We reserve the right to suspend or terminate accounts that provide false information.
- Marketplace Role
Nyxure is a multi-vendor online marketplace operated by Radhekishori Ecom Private Limited.
Unless explicitly stated otherwise:
• We do not manufacture products.
• We do not own inventory listed by third-party sellers.
• Products are supplied directly by independent vendors.
• Vendors are responsible for product descriptions, pricing, warranties, and legal compliance.
We facilitate transactions between customers and sellers.
- Account Registration
Users may be required to create an account.
You agree to:
• Provide truthful information.
• Keep your password secure.
• Update information when necessary.
• Not share your account with others.
You are responsible for all activity occurring under your account.
- Orders
Submitting an order constitutes an offer to purchase.
Orders are accepted only after successful payment confirmation (or order confirmation for Cash on Delivery where applicable).
An order confirmation email or message does not necessarily constitute acceptance of an order. Nyxure reserves the right to reject or cancel orders before shipment where permitted by applicable law.
We reserve the right to:
• Reject any order.
• Cancel suspicious transactions.
• Limit quantities.
• Request additional verification.
- Pricing
All prices displayed on the Marketplace are subject to change without notice.
In the event of an obvious pricing or typographical error, Nyxure reserves the right to cancel the affected order and issue a refund where applicable.
Prices may include or exclude applicable taxes depending on your location.
Shipping charges, taxes, and additional fees will be shown during checkout.
- Product Information
We strive to ensure product information is accurate.
However:
• Images may differ slightly from actual products.
• Colors may vary due to monitor settings.
• Specifications may change without notice.
• Availability is not guaranteed.
Customers should review product descriptions carefully before purchasing.
- Payments
We accept supported payment methods displayed during checkout.
Payment processing may be handled by third-party payment providers.
We do not store complete payment card information on our servers.
Failed or declined transactions may result in delayed or cancelled orders.
- Shipping & Delivery

The Marketplace is not responsible for delays outside our reasonable control.
- Cancellations
Orders may be cancelled before shipment, subject to vendor policies.
Orders already shipped may not be cancelled.

- Returns & Refunds

- Vendor Responsibility
Each seller is solely responsible for:

• Product legality
• Product warranties
• Taxes applicable to their business
• Customer support related to their products
The Marketplace may moderate disputes but is not the manufacturer or supplier of vendor products unless stated otherwise.
- User Conduct
Users agree not to:
• Violate any law or regulation.
• Upload malicious software.
• Attempt unauthorized access.
• Interfere with Marketplace operations.
• Submit false reviews.
• Impersonate another person.
• Abuse customer support.
• Engage in fraudulent activities.
Violation may result in suspension or permanent account termination.
- Reviews and Ratings
Users may submit reviews for products they have purchased.
Reviews must:
• Be honest.
• Be respectful.
• Not contain abusive language.
• Not include illegal or defamatory content.
• Not promote unrelated products or services.
We reserve the right to remove reviews that violate these Terms.
- Intellectual Property
All Marketplace content, including but not limited to:
• Logos
• Graphics
• Website design
• Icons
• Text
• Software
• Images (unless provided by vendors)
Is protected by applicable intellectual property laws.
Users may not reproduce, distribute, or modify Marketplace content without prior written permission.
- Vendor Content
Vendors retain ownership of their original content.
By uploading content to the Marketplace, vendors grant us a non-exclusive, worldwide license to display, reproduce, and distribute that content as necessary to operate and promote the Marketplace.
Vendors are responsible for ensuring they have the rights to the content they upload.
- Prohibited Products
The Marketplace may prohibit listings including, but not limited to:
• Counterfeit products
• Stolen goods
• Illegal drugs
• Unauthorized pharmaceuticals
• Dangerous goods prohibited by law
• Weapons prohibited by law
• Copyright-infringing products
• Products violating trademarks or patents
• Adult products where prohibited by applicable law
- Account Suspension
We may suspend or terminate accounts that:
• Violate these Terms.
• Engage in fraud.
• Abuse the Marketplace.
• Harm other users.
• Repeatedly breach Marketplace policies.
Termination may occur without prior notice where permitted by law.
- Limitation of Liability
To the fullest extent permitted by law, the Marketplace shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Marketplace.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
- Indemnification
You agree to indemnify and hold harmless the Marketplace, its owners, employees, and affiliates from claims, damages, liabilities, and expenses arising from your misuse of the Marketplace or your violation of these Terms.
- Privacy
Your use of Nyxure is also governed by our Privacy Policy, which forms an integral part of these Terms & Conditions.

- Third-Party Services
Our Marketplace may integrate with third-party services such as:
• Payment gateways
• Shipping providers
• Analytics services
• Marketing platforms
Their services are governed by their own terms and privacy policies.
- Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, war, labor disputes, internet outages, governmental actions, or pandemics.
- Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted on this page with a revised “Last Updated” date.
Continued use of the Marketplace after changes become effective constitutes acceptance of the revised Terms.
- Vendor Commission
Nyxure operates as a multi-vendor marketplace where independent sellers may list and sell products to customers. In consideration for providing the Marketplace, technology platform, payment facilitation, and related services, Nyxure may charge sellers a commission or other applicable marketplace fees.
The commission percentage, transaction fees, subscription charges, promotional fees, or other applicable charges shall be determined by Nyxure from time to time and may vary based on the seller category, product category, promotional programs, or other business considerations.
All applicable commissions and fees will be communicated to sellers through their seller dashboard, applicable seller agreements, or official communications.
Nyxure reserves the right to modify its commission structure, fee schedule, or payment policies at any time. Any such changes will be communicated to sellers before becoming effective.
Sellers authorize Nyxure to deduct applicable commissions, taxes, marketplace fees, payment gateway charges, shipping adjustments (where applicable), refunds, penalties, and other authorized deductions from amounts payable to the seller.
Commission rates may differ between product categories, promotional programs, or individual seller agreements.
- GST Compliance
Sellers are solely responsible for complying with all applicable tax laws, including but not limited to the Goods and Services Tax (GST), income tax, and any other indirect or direct taxes applicable under Indian law.
Each seller shall ensure that:
• All applicable GST registrations are obtained where legally required.
• GSTIN and business information provided to Nyxure are accurate and up to date.
• Applicable taxes are correctly charged, collected, reported, and remitted to the appropriate government authorities.
• Tax invoices issued to customers comply with applicable legal requirements.
Nyxure acts as a marketplace intermediary and does not assume responsibility for the tax compliance obligations of individual sellers unless expressly required under applicable law.
Where required by applicable law, Nyxure may collect, deduct, withhold, report, or remit taxes, including Tax Collected at Source (TCS) under the Goods and Services Tax Act or other applicable tax provisions.
Failure by a seller to comply with applicable tax laws may result in suspension or termination of the seller account, withholding of payouts where legally permitted, or other actions deemed necessary to comply with applicable laws.
- Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal, India, unless applicable consumer protection laws require otherwise.
